  1. General Terms and Conditions (GTC)

For orders placed via www.milija.ch, Merowingerweg 1, 5079 Zeihen/AG apply to all orders for goods placed via the www.milija.ch online shop, as well as contracts concluded with shop@milija.ch and milija GmbH.

When concluding an order with milija GmbH, www.milija.ch or shop@milija.ch by mail, by phone or in the online shop, you enter into a contractual relationship with milija GmbH. This contractual relationship is exclusively regulated by the “GTC”.

For the order and delivery offer these “GTC” are valid. Only goods are sent to delivery addresses within Switzerland, the Principality of Liechtenstein. Orders via this online shop can only be placed by persons of full age with valid residence.

Milija GmbH expressly reserves the right to change the present “GTC” at any time. The “GTC” which was current at the time of the conclusion of the contract is decisive.

 

  1. Conclusion of contract

We conclude contracts via www.milija.ch exclusively in the German language. When ordering milija shoe articles, your contractual partner is milija GmbH, Merowingerweg 1, 5079 Zeihen.

The presentation of the products in the online shop is not a legally binding offer, but a non-binding online catalogue. If there are products in the “shopping cart” then this is not yet a binding order, only after clicking the button “send order”. The order confirmation will be sent immediately by an automated e-mail, but this does not constitute an acceptance of contract by milija GmbH. The contract is concluded by a contract confirmation or by delivery of the goods within five working days.

Goods from the offer in the online shop can be moved to the electronic shopping cart by selecting and clicking the button “Add to cart”. An order will only be placed when all data required for the execution of the contract have been entered, the acknowledgement of these “General Terms and Conditions” has been confirmed and the button “Submit Order” has been clicked. Before this button is clicked, the order as well as the given data can be changed at any time.

Once the order has been placed, an automatically generated confirmation of receipt is sent by e-mail. This contains the data of your order as well as these “GTC” and the data protection regulation. The confirmation of receipt does not constitute a purchase contract. The confirmation of receipt only documents that the order has been received by millija GmbH. Millija GmbH reserves the right to refuse the acceptance of the order and the conclusion of the sales contract. The acceptance of the order by milija GmbH is subject to the availability of the ordered goods.

  1. Prices

All prices are quoted in Swiss francs, including VAT.

milija GmbH can change or adapt the prices at any time. The prices valid at the time of conclusion of the contract are decisive for each individual order.

 

  1. Price reduction through promotions

If the order date falls within the period of a promotion with a price reduction, the customer is entitled to a price reduction for the items advertised in the promotion. If the order date is outside the specified period, there is no entitlement to a price reduction on ordered items in the promotion.

 

  1. Payment modalities

Basically we offer the payment methods twint, credit card and prepayment. We reserve the right not to offer certain payment methods and to refer to other payment methods for each order. Please note that we only accept payments from accounts in Switzerland and within the European Union (EU). Any costs of a money transaction are to be borne by you. In the case of purchases made by twint or credit card, your account will be debited when we confirm your order. If you pay in advance, the product will be reserved for you for a maximum of 7 days from the order date. If payment is not made within this period, the order will be cancelled without prior notification by milija GmbH.

 

  1. Default of payment & assignment

If payment is not made within 30 days of the due date, the customer shall be in default. In this case milija GmbH reserves the right to charge the customer a reminder fee of CHF 10.00 per reminder in addition to the invoice amount. The open invoice amount (incl. interest on arrears and reminder fees) can be given or sold for the purpose of collection. In addition to the settlement of the invoice amount, the customer is also obliged to reimburse all costs incurred by the delay in payment.

You agree to receive invoices, credit notes and reminders in electronic or paper form. We reserve the right of ownership of the purchased item until the invoice amount has been paid in full. The corresponding security rights are transferable to third parties.

 

  1. Shipping and delivery
    • The delivery is always free of shipping costs.
    • The ordered goods will only be sent to addresses in Switzerland or the Principality of Liechtenstein.
    • Within Switzerland and the Principality of Liechtenstein we send your delivery by the Swiss Post. With your order you expressly agree to the carrier.
    • If the delivery to a post office box is desired, only the following payment options are available: Credit card/advance payment
    • When the goods are handed over to the carrier (Swiss Post), the liability is also transferred to the carrier.
    • If an item cannot be delivered for any reason after receipt of your order, you will be informed as soon as possible, but no later than 15 working days after receipt of your order. In this case, your order for the unavailable item will be considered rejected. For the available articles the contract is concluded according to point 2.

 

  1. Compensation for damages

Claims for damages due to incorrect illustrations, incorrect prices, incorrect texts, delayed or omitted deliveries are excluded and are strictly rejected.

 

  1. Reservation of proprietary rights

Until complete payment the goods remain property of milija GmbH, Merowingerweg 1, 5079 Zeihen.

 

  1. Right of withdrawal / return

www.milija.ch and shop@milija.ch milija GmbH grants you a voluntary right of return of a total of 14 days from receipt of goods. Afterwards you can cancel the contract by returning the goods to milija GmbH within 14 days after receipt of the goods (deadline starts the day after receipt of goods). Punctual dispatch is sufficient to meet the deadline. The condition for the exercise of the right of return is, however, that you have only worn the goods for trying on, as in a retail shop, and return the goods complete and undamaged. We also ask that you return the goods in their original packaging. The right of return does not apply to the purchase of gift vouchers. We will also refund any payments received within 14 days of the cancellation. However, we can refuse to refund until we have received the goods back.

In the event of a cancellation, please return the goods to us immediately with the original packaging. We ask you to use the enclosed return note when placing the return. The costs for returning the goods by post are to be borne by you.

  1. Warranty

In case of defects of goods the legal warranty rules apply. In the case of delivery recognizable, obvious material or manufacturing defects in our articles, we ask you to report this immediately. We will replace the defective goods free of charge, after the defective goods have been returned.

As far as legally permissible, other claims are excluded, regardless of the legal basis. Milija GmbH, its auxiliary persons and possible vicarious agents are not liable for damages that have not occurred on the goods themselves, especially not for consequential damages, lost profit or other financial losses of the customer.

 

  1. Our 100% guarantee

If the customer is not satisfied with the goods purchased in the milija shoes online shop after the end of the revocation period for a reason according to paragraph 14, the goods can be returned to milija GmbH together with the invoice or purchase receipt. The return shipment is at the expense and risk of the customer.

The customer can choose between exchanging the goods for an equivalent model, a voucher in the amount of the purchase price or a refund of the purchase price. Other warranty claims are excluded.

The right of return based on the 100% guarantee only exists if the purchase receipt or the invoice is presented and applies to all shoes of milija GmbH.

 

  1. Social media

After the user has given his consent, milija GmbH reserves the right to publish contents of customers who post them on social media and have a direct reference to the company milija GmbH (e.g. by illustrating the products or using a hashtag like #milija, #milija shoes or similar) on its website and to link the contents to the corresponding products.

 

  1. Image rights

All image rights are held by milija GmbH, Merowingerweg 1, 5079 Zeihen. A use without explicit approval is not allowed.

 

  1. Disclaimer for external links

We refer to our pages with links to other pages on the Internet. The following applies to all these links: www.milija.ch expressly declares that it has no influence on the design and content of the linked pages. Therefore, milija GmbH hereby expressly dissociates itself from all contents of all linked pages of third parties on www.milija.ch and does not adopt these contents. This declaration is valid for all displayed links and for all contents of the pages to which links lead.

 

  1. Applicable law / Place of jurisdiction

The substantive law of Switzerland applies exclusively, excluding the United Nations Convention on Contracts for the International Sale of Goods (Vienna Sales Convention).

Any legal disputes in connection with the online shop and your purchases of goods must be settled in Switzerland, either at the ordinary courts at your place of residence or at the registered office of milija GmbH. The place of jurisdiction is determined according to article 22 of the law on the place of jurisdiction.

Should individual provisions of these “GTC” be or become invalid or ineffective or should the “GTC” contain loopholes, the validity of the remaining provisions and the “GTC” shall remain unaffected. In place of invalid or missing provisions, the dispositive law shall apply.

  1. Gift card GTC

Gift vouchers are vouchers that you can purchase. They can only be redeemed for the purchase of milija shoes, not for the purchase of other gift vouchers. If the credit balance of a gift voucher is not sufficient for the order, the difference can be balanced with the offered payment options. Gift vouchers and credits can only be redeemed before the order process is completed. The credit balance of a gift voucher is neither paid out in cash nor does it bear interest. To redeem a gift certificate in your account, please use the coupon code during the payment process.
